Capital One 2019 Canadian Data Breach Settlement
Why this might matter to you
The court approved a $35 million fund for the 2019 Capital One data breach on October 21, 2026. The published terms offer three possible claim categories: eligible breach-related out-of-pocket expenses up to $25,000; time responding to the breach at $25 per hour, with a $75 top-up (up to $200 without an affected SIN or $275 with one); and up to $50 for qualifying annual card fees. These are category limits, not promised payments. Legal and administration costs come out of the fund. Capital One denies wrongdoing.
The class covers Canadian residents outside Québec who applied for or were issued a Capital One credit card and received a Capital One notice that their information may have been affected by the 2019 breach. SIN status changes the time-payment category; certain annual card fees paid from July 31, 2013 to July 31, 2019 may qualify separately. Claims are not yet open.
